1. Acceptance of Terms

By creating an account or using the services provided by EquiStable LLC ("EquiStable", "we", "us", or "our"), you agree to be bound by these Terms and Conditions ("T&C"). If you do not agree to these terms, please do not use the services.

2. Description of Service

EquiStable provides a comprehensive SaaS solution for the management of equestrian facilities, including but not limited to resource booking, equine health management, feed planning, and AI-powered ride analysis (the "Services").

3. User Accounts

You are responsible for safeguarding your account and for all activities that occur under it. You must provide accurate and complete information and keep your account information up to date. You must notify us immediately of any unauthorized use of your account.

4. Subscriptions and Payments

Fees: Certain features of the Services require the payment of fees, either as a one-time purchase (e.g., credit top-up) or as a recurring subscription (e.g., facility SaaS subscription, rider premium subscription).
Billing: We use Stripe, a third-party payment processor, to handle billing through a payment account linked to your account. The processing of payments is subject to Stripe's terms and privacy policies.
Internal Credit System: Users can purchase credits to pay for services within the platform. Credits are non-refundable and have no cash value.

5. User Content and Data

You retain ownership of all information and content you upload to the Services, including your personal data, horse data, and riding data ("User Content"). You grant us a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, and create derivative works (e.g., those resulting from our AI analysis) solely for the purpose of operating, providing, and improving the Services for you.

6. Important Notice & Disclaimer

THE SERVICES ARE PROVIDED "AS IS" (WITHOUT WARRANTY OF ANY KIND). THE AI-POWERED MOVEMENT AND RHYTHM ANALYSIS AND ALL HEALTH-RELATED RECOMMENDATIONS ARE FOR INFORMATIONAL PURPOSES ONLY AND ARE NO SUBSTITUTE FOR PROFESSIONAL VETERINARY ADVICE, DIAGNOSIS, OR TREATMENT. ALWAYS CONSULT A QUALIFIED VETERINARIAN WITH ANY QUESTIONS REGARDING YOUR HORSE'S HEALTH.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EQUISTABLE LLC SHALL IN NO EVENT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR FOR ANY LOSS OF DATA, USE, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICES.

8. Governing Law

These T&C are governed by the laws of the State of Wyoming, USA, excluding its conflict of law principles. For disputes arising out of or in connection with contracts between local stable operators and end customers, the mandatory legal provisions of the respective country of residence (e.g., Austria) shall additionally apply.
